Terms of Service & Refund Policy

These terms apply to your use of DeskVal and to any report you order from us. By submitting an order you agree to these terms. Please read the "What DeskVal is — and is not" section carefully.

1. What DeskVal is — and is not

A DeskVal report is an indicative market price opinion — it is not a certified valuation. It is a desktop assessment based on comparable sales evidence and publicly available information, prepared to give you an independent view of likely market value. It is not a valuation prepared by a Certified Practising Valuer, and it must not be used or relied upon where a formal valuation is required.

It is comparable in nature to a real estate agent's appraisal / comparative market analysis (CMA), provided independently — we have no listing to win and earn no commission.

2. Excluded purposes

You must not use, and must not provide to any third party for use, a DeskVal report for any of the following purposes. A registered/certified valuer (or relevant qualified professional) must be engaged instead:

We may decline or cancel any order we reasonably believe is for an excluded purpose, and refund it in full.

3. Your responsibility and reliance

A DeskVal report is general, indicative information to support your own decision-making. It does not take into account your personal objectives, financial situation or needs, and is not financial, investment, tax or legal advice. You remain responsible for your own decisions, and should obtain your own professional advice (including a formal valuation where required) before acting. Figures are estimates and the actual sale or purchase price may differ.

4. The reports and turnaround

Prices are in Australian dollars [GST treatment — TBC]. Turnaround times are indicative targets from receipt of payment and the information we need, not guarantees.

5. Ordering and payment

Submitting the order form is a request, not a binding order. We confirm by email and send a secure payment link (processed by Stripe). Work begins once payment is received and we have the details we need. We may ask you for further information to complete your report.

6. Refund policy

Your consumer rights. Nothing in this policy limits or excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded — including the consumer guarantee that services are provided with due care and skill. Our refund policy operates in addition to those rights.

7. Accuracy and limitation of liability

We prepare each report with due care and skill, using sources we reasonably believe to be reliable. We do not warrant that third-party data (including sales records and market data) is complete or error-free, or that any estimate will match an actual transaction price. To the maximum extent permitted by law, and subject to section 6 above and the Australian Consumer Law, our total liability to you arising from a report or these terms is limited to the fee you paid for that report. We are not liable for indirect or consequential loss.

8. Intellectual property

We grant you a licence to use your report for your own personal, non-excluded purpose. We retain all intellectual property in our methodology, templates and the report format. You must not resell, republish or represent a DeskVal report as a certified valuation.

9. Privacy

We handle your personal information in accordance with our Privacy Policy.

10. Governing law

These terms are governed by the laws of [State/Territory — TBC, to match the operating entity], Australia, and you submit to the non-exclusive jurisdiction of its courts.

11. Changes

We may update these terms from time to time. The version in force is the one published here at the time of your order.
